Madonna Urges Judge to Dismiss Lawsuit Over Late Concerts: ‘Waking Up Early Not Reason for Legal Action’

Madonna is pushing back against a lawsuit filed by fans over the delayed start times of her New York City concerts, with her lawyers requesting a federal judge to dismiss the class action suit. The lawsuit, filed in January by concertgoers Michael Fellows and Jonathan Hadden, claimed that Madonna’s concerts started hours past the advertised time, causing inconvenience to attendees who had to wake up early for work the next day. However, Madonna’s legal team argues that this does not constitute a legal injury for which she can be sued.

The lawsuit stemmed from Madonna’s December 2023 concerts at Brooklyn’s Barclays Center, where she allegedly took the stage after 10:30 p.m. despite the advertised start times of 8:30 p.m. Fellows and Hadden accused Madonna of false advertising, negligent misrepresentation, and unfair and deceptive trade practices.

Madonna’s lawyers countered these claims by stating that there was nothing unreasonable about the timing of the concerts and that attendees received what they paid for. They argued that concertgoers should have understood that the headline act at a major arena concert would take the stage later in the evening, following the opening acts.

Furthermore, Madonna’s legal team emphasized that the lawsuit did not allege any shortcomings in Madonna’s performance or that attendees left the concert early due to dissatisfaction. They asserted that Madonna’s performance was not subpar and that fans got their money’s worth.

The pop star’s representatives did not immediately respond to requests for comment from Page Six regarding the lawsuit. However, several fans expressed disappointment and frustration on social media over the delayed start times, with some demanding refunds for the inconvenience.

Madonna’s “Celebration” tour, which kicked off in London in October 2023, has been marked by various incidents and controversies, including the pop icon’s on-stage fall in Seattle and her confrontation with a wheelchair-bound concertgoer in Los Angeles. Despite these challenges, Madonna has continued to perform and entertain her fans around the world.

Overall, Madonna’s legal team’s argument suggests that the delayed start times of her concerts were not grounds for legal action, emphasizing that concertgoers should have reasonably expected such delays at major arena events.
