Six months after the high-profile dismissal of the “Rust” shooting case, Alec Baldwin has launched a lawsuit against prosecutors and officials involved, alleging malicious prosecution, defamation, intentional spoilation of evidence, and violations of the New Mexico Civil Rights Act. The Allegations
Baldwin’s suit names the Santa Fe County Sheriff’s Office, the Santa Fe County Board of County Commissioners, and representatives of the First Judicial District Attorney as defendants. According to the filing, Alec Baldwin accuses them of targeting him unfairly, claiming they were determined to convict him for “the wrong reasons, and at any cost.”
The case stems from the fatal 2021 shooting on the set of Rust, when a gun Baldwin was holding discharged, killing Hutchins. Baldwin insists the weapon was presented to him as a “cold gun,” meaning it was not loaded with live ammunition.

In January 2024, Baldwin was indicted on charges related to the incident. However, his legal team argued that critical evidence was withheld, resulting in the indictment being withdrawn in July 2024. Prosecutors formally dismissed the case last month after dropping their notice to appeal.
The actor’s lawsuit accuses special prosecutor Kari Morrissey of providing inconsistent testimony and District Attorney Mary Carmack-Altwies of defaming him during a 2023 CNN interview. In the interview, Carmack-Altwies claimed Baldwin failed to ensure the set’s safety, an assertion his legal team strongly disputes.

“Kari Morrissey and the other defendants violated that basic principle [of justice], over and over, and trampled on Alec Baldwin’s rights. We bring this action to hold the defendants accountable for their misconduct and to prevent them from doing this to anyone else.”
