A 49-year-old man, Scott Peterson was convicted for the 2002 murder of his wife and their unborn son. On Wednesday, 8 December 2021, Scott was resentenced to life in prison without the possibility of parole.
Jurors Raised Objections
Scott Peterson was officially arrested in 2004. He spent 15 years on death row till his death penalty was removed in August 2020 because of improper screening of the jurors.
Simultaneously, the California Supreme court disclosed that many jurors were dismissed from the case after they expressed their objection to the death penalty.
In the meantime, juror Richelle Nice was accused of ‘prejudicial misconduct’ for hiding her history of domestic violence and not charging a restraining order issued in 2000 against her boyfriend’s ex-girlfriend over fears of harming her unborn child.
In spite of the fact that the selection of an impartial jury was questioned, juror Nice opposed being under the influence of her own personal experience. Because of that situation, Scott Peterson’s death penalty was overturned but his conviction still remained in place.
Earlier in 2021, Stanislaus County district attorney Birgit Fladger confirmed that Nice would not ask the court to reinstate Peterson’s death penalty after speaking with the victim’s family. This was because the whole process of talking to the victim’s family was very painful for the family to go through again.
On Wednesday, Scott Petersons’ defense attorney, Pat Harris said that the former wanted to speak in court, but the Superior Court Judge Anne-Christine Massullo denied the request as the sentence was predecided.
